If I win, do I have to pay capital gains tax or stamp duty?

Irish tax legislation holds that any winnings from betting, lotteries, sweepstakes or games with prizes are exempt from Irish capital gains tax (CGT). The prize will also be exempt from capital acquisitions tax (CAT). Stamp duty on transfers of residential property is chargeable at the rate of 1% where the market value does not exceed €1 million and is payable by the transferee (in this case the winner).

In the terms on our website, clause 28 covers this in more detail: Conveyancing and registration of the property shall be arranged between the solicitor for the Builder and a solicitor to be arranged by and on behalf of the winner. The winner is responsible for his/her own side’s legal fees and any costs of registration of the property, including any stamp duty, land registry fees, searches or other fees or charges.

How is the house draw being conducted and will the draw be overseen, by an independent adjudicator?

The draw will be conducted by drawing a unique number from a drum with all unique entries inside. An independent person will draw the winning entry and it will be overseen by an independent adjudicator. We also recommend you read the terms and conditions document prior to entering the competition.
